Q: new car move out of state?
I am Illinois resident and I will be moving to Ohio for the new job next week. I plan to buy a new car from Illinois and drive it there this weekend, do I pay the Illinois sales tax, Ohio, or both? Also, will the new car dealer do the tax, title, document for me?

A: If you are an Ohio resident, Ohio requires that the total sales tax you pay be equal to or greater than the Ohio sales tax. Thus, if you pay sales tax on the car in Illinois (and I think you will) and it is less than the Ohio sales tax, you will have to pay the extra when you title the car. If you pay no sales tax in Illinois, you will have to pay the whole of the Ohio tax. The sales tax percentage in Ohio varies by county.
If you are not an Ohio resident, and, when you become an Ohio resident, you are bringing in a car that already has a valid title in your name from another state, you will not have to pay Ohio sales tax when you get an Ohio title.
In your case, it seems to depend on whether you will have time to get a title in Illinois before you enter Ohio. If you bring the car into Ohio with a transfer title, the first situation above will apply to you. What will then be required in Ohio is that you take the car to an Ohio car dealer to verify that the car’s VIN number matches the number on the transfer title. There is no charge for this. They just fill out a form that you take to the Ohio title office. At the title office, they will determine how much sales tax you owe, if any, and collect it at the time you pay the titling fee. Once you get an Ohio title, you can get Ohio license plates.

I am looking at buying a car in Missouri (where I currently live), but will be moving to Illinois before the 30 day temp tag is up, so want to just go ahead and get it tagged in Illinois and skip getting it done in missouri. How will that work for the sales tax and tagging, etc.? They don’t include the taxes in the loan here, so you have to pay it seperately at the DMV

A: In order to get the 30 day tag in Missouri you will first need to apply for a Missouri title and pay Missouri tax. When you move to Illinois you will have to apply for an Illinois title and may have to pay Illinois tax as well because of the short time you owned the car.

If you know what your Illinois address will be just apply for an Illinois title and registration immediately.

Q: Generally speaking, how much am I expected to pay on sales tax for a used car. Can anyone give me an estimate?
I want to purchased a used 2003 Cadillac CTS in the state of Illinois. About how much sales tax do you think I will have to pay?

Okay this can get complicated so I’m gonna break it down step for step.

(I’m in the military so I move around a lot)
- I bought my first car in Illinois about a year ago
- I moved to Virginia and still have my car
- I’m moving to Hawaii and need to sell my car
- My car is registered and the title is through Illinois DMV
- My bank is my lean holder on the car and I still owe about 8k on the car
- I contacted my bank and they said after the check from the buyer goes through it can take up to 30 days for me to receive the Title on the car so I can sign it over to the buyer.

Okay question time:
- What documents will I need to sell my car in a different state than where its registered
- Is there anyway to speed up the process to get the buyer the title quicker
- Will the new buyer be able to drive the car
- What documents will I need to be able to sell the car i.e bill of sale, ext.
- I’ve never sold a car before. I really have no idea what to do so any extra info you think I’ll need would be appreciated as well.
Honestly I don’t really want it anymore. Its a muscle car and its so loud I get to much attention in it. I’m not a huge fan

A: Best thing to do at this point is visit the nearest DMV and they will give you the best solution. Question for you though, do you want to keep the car or do you like the car, is it worth keeping? good luck!!!

Q: As a resident of Illinois, can I use sales tax as a tax deduction for a 2007 new car purchase?

A: For federal Schedule A deductions you can deduct ‘either’ state income tax OR sales tax (not both). So deducting sales tax would make sense if that exceeds your state income tax. It would also help to have all other receipts from the year.

A: Most states allow cars to be “gifted” within the family. All that’s required (usually) is a signed affidavit from the seller stating the car was a gift. The sales tax in those cases is waived.

In the case of a gift, the car’s Blue Book value would be used to determine the amount of tax you’d have to pay, even though your receipt says $1.

Q: New car registered in West Virginia and moving to PA?
I bought a new car in WV and moved to PA. Now I have a PA driving license but if I register my car in PA its going to cost me a lot. How do I go about it? If I wait for 6 months I can fore go the sales tax, but if less than 6 months I would have to pay full sales tax. Kindly help me with this. What happens if I drive my car in PA registered in WV with a PA dl. Can I wait for another 5 months and register it in PA and not pay the sales tax. A: In order to stay compliant with PA laws, you LEGALLY MUST make application for Pennsylvania title and registration of their vehicle(s) within 20 days of establishing residency in Pennsylvania. Although new residents have 60 days to obtain a Pennsylvania driver’s license, there is nothing to prevent them from obtaining their Pennsylvania driver’s license sooner.

If you hold a valid title issued in another state and, have owned the vehicle at least 6 months before moving to Pennsylvania, you will not be required to pay any sales tax when you register your vehicle in Pennsylvania.
If it has been less than 6 months, you will need to provide your sales tax receipt, or remit PA sales tax. Applicants exempt from Pennsylvania sales tax will list the appropriate Sales Tax Exemption reason code in Sections 1A and/or 1B on Form MV-1.

Indicated on Page 13 of attached link the DMV on form MV-1 states:
#25. West Virginia- Motor Vehicles are subject to title privledge tax against which sales tax credit is not granted.

It seems that per the MV-1 form there is not much of an option for you.

There are pretty much only 2 exceptions to the rule:
#1 Snow birds- those who live in FL durning the winter and live in PA in the summer
#2 College Students- their permanent dwelling or location is in another state, but are temporarily in PA for school

Sorry to bring you bad news, but it doesn’t seem that you have an ability to get out of the sales tax. It is important to stay legal with the state and get an application turned into the state within 20 days of residency in PA.

I believe if you do not remain compliant with state law they might be able to suspend your drivers license.

Q: Getting a title for a car in Texas?
I have a ‘56 Beetle that I bought about a year ago with no title, just a bill of sale. The last owner died nearly 40 years so there was no title. I currently live in Illinois but was a past Texas resident. Would it be possible to write up a bill of sale, selling the car to my sister who lives in Texas, and then buy it back from her without ever taking the car back to Texas? I know your torn.You want this car,BAD. But the only legal way is the Prior owner signature requesting a duplicate title from the State Of Texas. You will also need the dead prior owners drivers license. Sounds like your in a BIG pickle. How you going to do this? If you send for a duplicate,It would have to be mailed to the prior owners last known address. So, again: who sold you the car? Your right,the Bonding would cost you Way too much but just how bad do you want this car? It may be worth the effort and fee to get the Bonding Insurance policy. My deceased brother-in-law paid his girlfriend $500.00 for what he thought was her car. Turns out it belongs to her ex-boyfriend, it is titled in the ex boyfriends name and it also has a lien on the title. We have possession of the vehicle, can she be in trouble for selling a car that was not hers and is the family legally entitled to getting the $500 back from her? She signed a bill of sale also. We live in the state of Illinois and it is titled in Illinois.

I currently live in Arizona. The car I own is registered in Illinois. I am going to sell my car to someone that also lives in Arizona. What steps will need to be completed in the sale on my end, and then for the buyer to get the car registered in Arizona?

A: If you live in Arizona, and have been there more than 30 days, or are employed in the state, you should already have the vehicle transferred over and AZ plates on it. If you haven’t done that, and it has been longer than 30 days, there may be penalties to pay. Go to the DMV and transfer it to AZ, then the sale will go without a hitch.

After that, it’s just the usual steps, you sign as seller, he signs as buyer, it gets notarized, he takes it in to change it to his name.

I am buying a car from a private party in Madison Wisconsin. But I will be moving to Illinois in a week to start a job. Q: I’m buying a used car from Indiana, I live in Illinois. Is it legal for me to drive it back without plates?
Does Indiana have a ‘Drive-Away permit’ like Illinois has, or a ‘Transit Permit’ like Texas has? Both of those are temp plates that out of state buyers can EASILY get for use in transferring their newly bought cars back to THEIR states. I haven’t been able to find anything like this in Indiana!!! So, can I just drive home without plates? As long as I have the title and bill of sale with me? Its a 200 mile trip. Thanks!!!

I’ve been looking at a car for sale at a dealership in “Lewis Center”.

I’m from over in Illinois, its a far drive and I’m not sure if it checks out or not. I’d hate to drive the 4+ hours just to find out somethings obviously wrong.

Q: is there a law for buying a used car from a consumer to be protected against a damaged car?
I sold a car to this guy and he owes me some money. Before we made a deal, i asked him to get the car check out by a michanic to be sure that there was nothing wrong with it. He didn’t get it checked out and he agreed to the deal. After couple weeks, he gets the car checked out and finds that the car needs new ball joint. Now he doesn’t want to pay me the rest of the money because he thinks that there is a law in Illinois that states that after buying a car from a consumer, you have 30 days to check it out (i think that’s bs). And if there is something wrong with the car safety wise (he tells me that the wheel will fall off eventually) the consumer can’t sell it even if he didn’t know about it (i find that hard to believe) Some people told me that once you buy a car from consumer, it’s sold AS IS, no warranty. I made a mistake. I never got bill of sale because i trusted the guy. I gave him my signed title. And he paid cash. What can i do to get rest of my money from the guy?State of IL

A: I can’t find anything in Illinois that says that you sold the car as anything other than “as is.” I haven’t come across anything that supports his 30 day claim.

“Purchasing a used car is another matter. Used cars may be sold “as is” or with a limited warranty. If you purchase a car “as is” you are obtaining no warranty and in most cases the dealer is not obligated to stand by any oral representations he may have made prior to the purchase. If you are buying a car “as is” and the dealer has made certain representations about the car or has promised to repair certain problems with the car, get these promises in writing. Make the dealer set out what he is willing to do on the bill of sale. If the vehicle has a limited warranty, make sure the dealer puts in writing, what the warranty is, what it covers, and how long it lasts. Obtaining representations or promises in writing, will eliminate problems later on.” 1

This does not mean that you are problem free. The transaction hasn’t been completed and there are no written documents, You didn’t say how much he still owes you, but it will be hard to get it out of him if you only have your word against his. You might be able to get him to put in writing the terms of your agreement by getting him to send you a letter explaining his side of the story. Insist he put in the letter what he thinks is wrong, and most important for you, how much he promised to pay for the car.

You should also write down sooner rather than later every detail you can recall about the transaction. I’m concerned that you may have said something that might have given him the impression that the sale was conditional upon the inspection, which would be slightly different than making claims about how well the car runs.

Not getting a receipt for selling a car while signing over the title is just a bad idea but hopefully with a little effort, negotiating and patience, you won’t get burned too badly because of it.

Edit: lemon law does not apply to used cars, a lemon is a new car or product that never works properly because of design or production defects
